How a Nevada DUI Becomes a Felony
Nevada law provides three paths to a felony DUI allegation, depending on prior-offense history and whether the current accusation involves substantial bodily harm or death. Each can carry a state prison sentence and substantial fines.
Felony DUI allegations can arise from:
- A third DUI within seven years: A third offense during the seven-year lookback period is a Category B felony. It carries 1 to 6 years in prison, fines from $2,000 to $5,000, and a three-year driver’s license revocation. Probation is typically unavailable.
- A DUI causing substantial bodily harm or death: An impaired-driving allegation involving serious injury or death can be charged as a Category B felony, even on a first offense. The potential prison term generally ranges from 2 to 20 years.
- A DUI after a prior felony DUI conviction: A new DUI is a Category B felony when the accused has a prior felony DUI conviction, regardless of when that conviction occurred. The potential prison term is 2 to 15 years.
Felony DUI convictions aren’t eligible for record sealing under Nevada law, so the conviction remains on a person’s record permanently. Licensing, employment, and personal consequences may accompany the criminal penalties, making it important to assess the accusation and prior history early.

Felony DUI Cases in Washoe County Courts
Felony DUI cases in Washoe County are heard in the Second Judicial District Court. Larry K. Dunn spent two years as a Washoe County Deputy District Attorney before entering private practice, giving him experience with criminal cases from both sides of the courtroom.
Larry K. Dunn has personally tried more than 70 felony jury trials in Northern Nevada courts. That trial background complements our work with DUI evidence when a case involves both impaired-driving allegations and felony court procedures.
Treatment Court for Eligible Third-Offense Cases
The Second Judicial District Court operates a dedicated Felony DUI Court treatment program for some eligible third-time defendants. This is a court-administered option, and admission depends on eligibility and the court process.
An accepted participant pleads guilty and has sentencing delayed while completing a mandatory treatment program lasting 3 to 5 years. A participant who completes the program is sentenced as a second DUI offender. Someone who doesn’t complete it’s sentenced on the felony DUI.
The Criminal Case & Separate DMV Process
A DMV administrative hearing is separate from the criminal DUI case. Resolving the court charge doesn’t automatically resolve the driver’s license matter. A hearing request must be submitted within seven days of the arrest or receipt of blood-test results, depending on how the testing and notice occurred.
We’re available 24/7 for urgent criminal-law concerns and offer free initial consultations in person, by phone, or through a virtual meeting. Our digital communication tools help clients stay connected, and we provide clear updates as the case progresses.
